These Terms of Service govern access to and use of tessymodesthome.com and purchases made through the online store. The seller and website operator is TESSY MODEST HOME DI GABRIEL TESSY, an Italian sole proprietorship with registered office at Via Mezzoiuso 40, 00132 Roma RM, Italy, Partita IVA 15643921008, REA RM-1763933, registered with the Registro delle Imprese di Roma.

By using the website or placing an order, you agree to these Terms. Mandatory rights granted to consumers by applicable law always prevail over any conflicting provision in these Terms.

2. Use of the online store

You may use the website only for lawful purposes. You must not interfere with its security or operation, introduce malicious code, attempt unauthorised access, scrape or copy content in a way that infringes rights, or use the Services for fraud or unlawful activity.

To place an order, you must have the legal capacity to enter into a contract. If you use an account, you are responsible for keeping your login credentials confidential and for notifying us promptly of suspected unauthorised use.

3. Products and information

We take reasonable care to describe and display products accurately. Screen settings, lighting, and photography may cause minor colour or scale differences. Measurements are approximate unless stated otherwise. The material, finish, size, and other confirmed characteristics of a product are described on its product page.

Product availability is not guaranteed until an order is accepted. We may correct genuine errors or update information where necessary. Nothing in this section limits rights relating to goods that are not as described or do not conform to the contract.

4. Prices, taxes, and promotions

Prices are shown in euros and include applicable VAT where required. The total payable amount is displayed before the order is submitted. Shipping charges and any available free-shipping threshold vary by destination and order value and are displayed at checkout. International customers may also be responsible for customs duties, import taxes, brokerage fees, or other destination-country charges unless checkout expressly states that they are included or collected in advance.

Promotions, discount codes, gifts, and minimum-spend offers are subject to the conditions displayed with the offer, including any dates, eligible products, minimum order value, and restrictions on combining promotions. Where a price reduction is announced, the prior price and reduction will be presented in accordance with applicable pricing law. We may withdraw or correct a promotion prospectively, but this does not affect an order already accepted except where permitted by law.

5. Placing an order and formation of the contract

Before submitting an order, you can review and correct the products, quantities, delivery information, and total price. Submitting the order constitutes an offer to buy the selected products. An automated acknowledgement only confirms receipt of the order. The sales contract is formed when we send confirmation that the order has been accepted or dispatched, depending on the communication you receive.

We may decline or cancel an order for a legitimate reason, including unavailability, an obvious pricing or description error, failed payment authorisation, suspected fraud, legal restrictions, or inability to deliver to the address supplied. If payment has already been taken for an order we do not accept, it will be refunded without undue delay.

6. Payment

Available payment methods are shown at checkout and may be provided by Shopify or other payment service providers. You must provide accurate billing information and be authorised to use the selected payment method. Payment data is processed by the relevant provider under its own security and privacy terms; we do not receive complete payment card details.

7. Shipping and delivery

We ship worldwide to destinations for which a delivery option is available at checkout. Orders are normally processed within 1–3 business days. Shipping rates, available methods, delivery estimates, and customs information are set out in our Shipping Policy and displayed at checkout where applicable. For consumer orders, risk normally passes when you or a third party designated by you physically receives the goods.

8. Withdrawal, returns, and refunds

Consumers generally have a 14-day right to withdraw from a distance contract, subject to statutory exceptions. Instructions, deadlines, return costs, and refund information are set out in our Return and Refund Policy.

9. Legal guarantee and advertised guarantee

Products sold to consumers are covered by the mandatory legal guarantee of conformity under Italian and European consumer law. The seller is responsible for a lack of conformity that becomes apparent within two years of delivery, subject to the conditions and remedies established by law.

Any separate two-year guarantee advertised by TESSY MODEST HOME is additional to the statutory legal guarantee and does not replace or restrict it. Guarantee requests may require the order number, a description of the issue, and reasonable photographic or video evidence so that the claim can be assessed.

10. Reviews and communications

If you submit a review, photograph, comment, or other content, you confirm that you have the right to share it and that it is not unlawful, misleading, abusive, defamatory, or infringing. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to display and use it for operating and promoting the store, subject to applicable privacy and consumer law. We may moderate or remove unlawful or inappropriate content.

11. Intellectual property

The website design, branding, logo, text, graphics, photographs, and other content are owned by or licensed to TESSY MODEST HOME and are protected by applicable intellectual-property law. Personal, non-commercial browsing is permitted. No other use, reproduction, distribution, or commercial exploitation is allowed without prior written permission or another lawful basis.

12. Third-party services and links

The website is powered by Shopify and may use third-party services for payments, delivery, analytics, customer support, and other functions. Links to third-party websites are provided for convenience. We are not responsible for independent third-party content or services, but nothing in this clause excludes responsibility that cannot lawfully be excluded.

13. Availability and liability

We aim to keep the website secure and available but cannot guarantee uninterrupted or error-free access. We may temporarily suspend access for maintenance, security, or events outside our reasonable control.

To the fullest extent permitted by law, we are not liable for indirect or unforeseeable losses that are not caused by our breach. Nothing in these Terms excludes or limits liability where exclusion would be unlawful, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer remedies.

14. Privacy

Personal information is handled as described in our Privacy Policy and in accordance with applicable data-protection law.

15. Changes to these Terms

We may update these Terms for legal, operational, security, or service-related reasons. The version displayed when an order is placed governs that order unless a mandatory legal change applies. Changes do not reduce rights already accrued.

16. Governing law and disputes

These Terms and sales contracts are governed by Italian law, without depriving consumers of mandatory protections available under the law of their habitual residence. Any dispute will be handled by the court determined under mandatory applicable law; for consumers, this includes the competent court of the consumer’s residence or domicile where required.

Please contact us first so that we can try to resolve any concern promptly. The European Commission’s former Online Dispute Resolution platform has been discontinued and is therefore not listed as an active dispute channel.

17. Severability and entire agreement

If a provision is found invalid or unenforceable, the remaining provisions continue to apply. These Terms, together with the policies referenced above and the information displayed during checkout, form the agreement governing the purchase.
